These Terms of Service (Terms) govern your access to and use of the LumeraMD website, online consultation and intake services, and related communications (the Services). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old and located in the United States in a jurisdiction where the Services are available. By using the Services, you represent that you meet these requirements and that all information you provide is accurate and complete.

2. Medical disclaimer and telehealth

The Services facilitate access to independent, licensed medical providers and pharmacies. LumeraMD is not a medical practice or pharmacy and does not itself practice medicine or provide medical advice. Information on the website is for general informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified provider with questions about a medical condition.

The Services are not for emergencies. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room.

3. Provider relationship

Any provider-patient relationship is formed solely between you and the licensed provider who reviews your intake, not with LumeraMD. Providers exercise independent professional judgment and may decline to issue a prescription if therapy is not clinically appropriate for you.

4. Prescriptions and consultations

All products offered through the Services are prescription-only. No product is dispensed without a medical evaluation and a valid prescription issued by a licensed provider. Submitting an intake or placing an order does not guarantee that a prescription will be issued.

5. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a safety or legal risk.

6. Orders, pricing, and payment

Prices are shown in U.S. dollars and may change at any time. We may correct errors, limit quantities, or refuse or cancel orders, including after an order has been placed. You authorize us and our payment processors to charge your payment method for amounts you approve, including products, applicable fees, taxes, and shipping.

7. Shipping and returns

Fulfillment, shipping, returns, and refunds are governed by our Shipping & Return Policy, which is incorporated into these Terms. For safety reasons, prescription products generally cannot be returned once shipped.

8. Acceptable use

You agree not to misuse the Services, including by providing false health or identity information, reselling or redistributing any product, using the Services on behalf of another person without authorization, attempting to access the Services unlawfully, or interfering with their operation or security.

9. Intellectual property

The Services and their content, including text, graphics, logos, and design, are owned by LumeraMD or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written permission.

10. User content

If you submit content or feedback, you grant us a non-exclusive, royalty-free license to use it to operate and improve the Services. You are responsible for the content you provide and represent that you have the right to share it.

11. Third-party services

The Services may rely on or link to third parties, including providers, pharmacies, and payment processors. We are not responsible for the acts, omissions, products, or content of third parties.

12. Disclaimers

The Services are provided on an as is and as available basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

13. Limitation of liability

To the fullest extent permitted by law, LumeraMD and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising from or related to your use of the Services. Our total liability for any claim will not exceed the amount you paid to us for the product or service giving rise to the claim.

14. Indemnification

You agree to indemnify and hold harmless LumeraMD and its affiliates from claims, losses, and expenses, including reasonable legal fees, arising from your misuse of the Services or violation of these Terms.

15. Governing law and dispute resolution

These Terms are governed by the laws of the state in which LumeraMD is organized, without regard to conflict-of-law rules. Any dispute will be resolved in the courts or through the dispute-resolution process designated by LumeraMD, to the extent permitted by law. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

16. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted with a new effective date, and your continued use of the Services constitutes acceptance of the changes.
